By accessing or using ScannerWire (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Age Eligibility

You must be at least 17 years old to use ScannerWire. The Service contains content derived from emergency radio communications that may include descriptions of violence, injury, death, criminal activity, and other mature subject matter. By using the Service, you represent and warrant that you are at least 17 years of age. If you are under 17, you may not access or use the Service under any circumstances.

3. Description of Service

ScannerWire provides real-time AI-transcribed and enriched summaries of publicly available emergency radio scanner feeds. The Service includes:

• Live feed of police, fire, and EMS radio activity
• AI-generated summaries and location extraction
• Push notifications for significant events
• Audio playback (when available)
• Map visualization of incidents

3. Important Disclaimers

3.1 Accuracy

Content is generated by AI from radio transmissions and may contain:

• Transcription errors
• Incorrect locations or addresses
• Misidentified incident types
• Delayed or outdated information
• Missing critical context

Always verify information from official sources before taking action.

3.2 No Professional Advice

ScannerWire does not provide legal, safety, or professional advice. The information is for general awareness only.

4. User Conduct

You agree NOT to:

• Interfere with or obstruct emergency services
• Use information to commit or facilitate crimes
• Harass, threaten, or harm individuals mentioned in scanner traffic
• Attempt to identify private individuals from scanner information
• Redistribute or republish content without permission
• Reverse engineer or attempt to access our systems
• Use automated tools to scrape or collect data
• Circumvent subscription requirements

5. Subscriptions and Payments

5.1 Subscription Terms

• Subscriptions are billed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled 24 hours before the renewal date
• Refunds are handled by Apple/Google per their policies

5.2 Demo Access

Demo keys provide limited-time access and are subject to availability. Demo access may be revoked at any time.

5.3 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified before their next renewal.

6. Intellectual Property

All content, features, and functionality are owned by ScannerWire or its licensors. You may not:

• Copy or modify the app or its components
• Use our trademarks without permission
• Redistribute content for commercial purposes

7. Privacy

Your use of the Service is also governed by our Privacy Policy.

8. Third-Party Services

The Service may contain links to or integrate with third-party services (e.g., maps, payment processors). We are not responsible for third-party content or practices.

9. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Any reason at our sole discretion

You may terminate your account at any time through Settings → Delete Account.

10. Assumption of Risk

You understand and agree that:

• The Service relies on AI-generated transcriptions of radio communications, which may be inaccurate, incomplete, delayed, or misleading
• Location data, incident classifications, severity ratings, and all other information may be incorrect
• The Service is not a substitute for official emergency services, law enforcement communications, or verified news reporting
• You should never take action (including but not limited to traveling to a location, evacuating, confronting individuals, or making safety decisions) based solely on information from ScannerWire
• Audio recordings may contain distressing content including descriptions of violence, injury, or death
• The Service may experience outages, data loss, or interruptions at any time without notice

11. Limitation of Liability and Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT
• THE SCANNERWIRE PARTIES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE
• THE SCANNERWIRE PARTIES SHALL NOT BE LIABLE FOR ANY ACTIONS YOU OR THIRD PARTIES TAKE BASED ON INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO TRAVELING TO AN INCIDENT LOCATION, MAKING SAFETY DECISIONS, OR RELYING ON AI-GENERATED CONTENT
• IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE SCANNERWIRE PARTIES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SCANNERWIRE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00)
• THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING NEGLIGENCE, STRICT LIABILITY, BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER THE SCANNERWIRE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

12. Waiver of Legal Action and Indemnification

You agree to indemnify, defend, and hold harmless the ScannerWire Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including privacy or intellectual property rights
• Any actions you take based on information provided by the Service
• Any content you submit through the Service
• Any harm caused to you or third parties resulting from your reliance on AI-generated content, transcriptions, location data, or any other information provided through the Service

This indemnification obligation will survive the termination of these Terms and your use of the Service.

13. Mandatory Binding Arbitration and Class Action Waiver

13.1 Agreement to Arbitrate

You and ScannerWire agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and NOT through court proceedings. You and ScannerWire are each waiving the right to a trial by jury or to participate in a class action.

13.2 Class Action Waiver

YOU AND SCANNERWIRE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator shall not consolidate more than one person's claims and shall not preside over any form of representative or class proceeding.

13.3 Arbitration Procedures

• Arbitration will be conducted in the State of Delaware or via telephone/video conference at your election
• The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
• Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise

13.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for Disputes within the court's jurisdiction. ScannerWire may also seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated through the app or via email.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any litigation permitted under these Terms (as excepted from the arbitration provision) shall be exclusively filed in the state or federal courts located in the State of Delaware.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. If the class action waiver in Section 14.2 is found unenforceable, then the entirety of the arbitration provision in Section 14 shall be null and void.

18. Force Majeure

ScannerWire shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, third-party service outages (including but not limited to AWS, Broadcastify, Google, or Apple), radio signal disruptions, or any other force majeure event.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScannerWire regarding your use of the Service. These Terms supersede all prior agreements, representations, and understandings between you and ScannerWire. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
